The US State Department has issued a global directive telling consular posts to enforce a tougher interpretation of the long-standing “public charge” ground of inadmissibility, a move that could make it harder for some visa applicants and green-card seekers to secure entry to the United States. The guidance — circulated to embassies and consulates worldwide — revives and expands rules seen under the Trump administration and relaxed during the previous US administration. Consular officers are now instructed to examine petitions, visa applications, medical reports, affidavits of support and any prior record of public assistance when deciding admissibility.

Under the updated screening protocol, routine factors such as age, health, English proficiency, financial resources and anticipated long-term need for medical or social-care support will be weighed more heavily. The direction explicitly notes that previous receipt of government cash assistance or institutionalisation can be considered grounds for denial.

Officials framed the policy as a return to “self-sufficiency” principles in US immigration, with an internal cable telling consular officers to scrutinise every aspect of an applicant’s case, from the affidavit of support to any newly uncovered information during vetting. Legal aid groups warned that while the guidance technically applies to a wide range of applicants, in practice it is most likely to affect those applying for immigrant visas and green cards rather than routine tourist or short-term work visas.
