HC: Tardeo high-rise won't stand as example; no illegality will be allowed

The Bombay High Court on Thursday criticized the Brihanmumbai Municipal Corporation (BMC) for ignoring serious violations at Willingdon View, a high-rise in Tardeo. The court made it clear that no illegality would be tolerated in any building and stated that this case would serve as a warning for all high-rises.

A division bench of Justices GS Kulkarni and Arif Doctor pointed out that the upper 18 floors of the 34-storey building were occupied without an occupancy certificate (OC), marking a significant violation. The court had earlier raised concerns about other issues, including fire safety violations and unauthorized alterations to the original building plans.

Expressing frustration over what it called the BMC's lax approach, the court questioned the civic body's commitment to addressing such issues. "Is the corporation treating this matter lightly? Should these residents continue living in the building?" the justices asked.

The court further warned that if the BMC failed to outline specific actions to resolve these violations, it would assume that the civic body was allowing residents to live in unsafe conditions, thereby endangering their lives.
