Expert warns Green Card holders with asylum status not to ‘travel back…’

People have been speaking out against the Donald Trump administration's immigration policies after a number of Indian citizens who typically hold H-1B visas and Green Cards were abruptly deported from the United States or arrested in another immigration-related case. “Asylum is granted because an individual demonstrates a well-founded fear of persecution in their home country,” New York-based immigration lawyer Bashu Phulara told NepYork.

The voluntary repatriation of an individual to that nation creates concerns for U.S. immigration officials. The repercussions can be dire, ranging from deportation to the loss of legal status, depending on the circumstances.

Even going back home might be construed under the act as proof that the individual no longer fears persecution by immigration judges and law enforcement, including U.S. Citizenship and Immigration Services (USCIS). Phulara cautions, "The government may start the process to terminate asylum if it thinks the initial asylum claim is no longer legitimate—or worse, was fraudulent."
